As part of the Labor Reform on Subcontracting approved last April 23, it was established that individuals or legal entities that provide specialized services must register with the Ministry of Labor and Social Welfare (Secretaría del Trabajo y Previsión Social.

 

In order to comply with this provision of the Federal Labor Law, a digital platform called “REPSE” was designed to allow its users to request registration in the Public Registry of Specialized Services or Specialized Works Contractors (the “Registry”).

 

Two main requirements are established to obtain the Registry: To demonstrate the specialized nature of both the individual or legal entity wishing to register, as well as the activity or activities that may be registered in the REPSE and; be current in their tax and social security obligations before the SAT, the IMSS and INFONAVIT; in addition to the requirements established in the Agreement disclosing the general provisions for the registration of individuals or legal entities that provide specialized services or perform specialized works.

 

Registration is exclusively for those who place workers at the disposal of a third party for the performance of services and specialized works contracted in a space or work center other than the one with which they have an employment relationship.

 

Once the registration is obtained, the individual or legal entity that provides services or specialized works is obliged to include in the contracts it enters its registration number and the folios of the activities of the corporate purpose, or the tax status certificate registered in the Registry and that correspond to the specific subcontracted activity.

 

All this to ensure that the services rendered are not part of the corporate purpose or main activity of the contracting party, otherwise, the registration could be cancelled.
