COFECE investigates the maritime transportation services market in the State of Quintana Roo.
The Federal Antitrust Commission (“COFECE”), published in the Official Journal of the Federation the initiation of an investigation for possible absolute monopolistic practices in the maritime transportation services market in the State of Quintana Roo.
According to the Federal Antitrust Law, absolute monopolistic practices are all contracts, agreements, arrangements or combinations between competing economic agents, whose object or effect is any of the following:
i) Fixing, raising, arranging, or manipulating the sale or purchase price of goods or services at which they are offered or demanded in the markets.
ii) Establish the obligation not to produce, process, distribute, commercialize, or acquire but only a restricted or limited quantity of goods or the provision or transaction of a restricted or limited number, volume, or frequency of services.
iii) To divide, distribute, allocate or impose portions or segments of an actual or potential market for goods and services, by means of determined or determinable customers, suppliers, times, or spaces.
iv) Establishing, arranging or coordinating bids or abstention in bids, tenders, or auctions.
v) To exchange information with any of the objects or effects referred to in the preceding paragraphs.
During the investigation, which will have a maximum period of 120 days, the Competition Authority may request information and make investigation visits in order to carry out all the necessary diligences for the due processing of the investigation.
