On December 1, two thousand twenty-two, in the presence of the members of the Board of Representatives of the National Minimum Wage Commission (“CONASAMI”), and exercising the powers granted to them by Article 123 of the Mexican Constitution, a wage increase for 2023 was approved.
Pursuant to Article 570 of the Federal Labor Law (the “Law”), minimum wages will be fixed each year and will become effective on January 1 of the following year; therefore, such wage increase will become effective on January 1st, 2023.
•Minimum Wage in Mexico
This wage increase is comprised of a percentage (increase by fixation) of 10% plus $15.72 Mexican pesos as part of the Independent Recovery Amount (“MIR”). The purpose of the MIR is to make it possible to recover the purchasing power of salaried workers who receive a minimum wage. In view of the above, the minimum daily wage would increase from $172.87 pesos to $207.44 pesos.
•Minimum Wage in the Northern Border Free Zone
The Northern Border Free Zone, a geographic area comprising 43 municipalities in the states of Baja California, Sonora, Chihuahua, Coahuila, Nuevo Leon and Tamaulipas, will have a 20% increase in the minimum wage; therefore, the daily pay per workday will be $312.41 pesos. This increase is composed of $23.67 pesos MIR plus a 10% increase for fixation.
