New guidelines for issuing online opinions or resolutions for the Federal Economic Competition Commission
On February 13, the Federal Economic Competition Commission (“COFECE” for its Spanish acronym,) published in the Federal Official Gazette (“DOF” for its Spanish acronym) the Guidelines for the issuance of opinions or resolutions in the granting of licenses, concessions, permits and similar, by electronic means (“Guidelines”).
These Guidelines provide the bases for submitting and handling requests for opinions or resolutions in the granting of licenses, concessions, permits, assignments, sale of shares of concessionaires or permit holders or other similar matters (the “Requests”).
These Guidelines shall be applicable in general and mandatory for the following:

Users of COFECE’s Electronic Procedures System (“SITEC” for its Spanish acronym).

Economic agents and public authorities that issue opinions or authorizations in the granting of licenses, concessions, permits, assignments, sale of shares of concessionaires or permit holders or other similar matters (the “Applicants”).
It is expected that an Electronic Bidding and Opinion Request System (“SISELO” for its Spanish acronym) will be created, which will be used to submit the Requests.
When a Request is submitted through SISELO, an electronic file is opened, which will contain all the documents and actions issued during the handling of the Requests, authorize individuals who will have access to the electronic file, as well as specify which information is confidential.
The Guidelines will enter into force on the day following the publication in the DOF of COFECE Board’s resolution declaring that the SISELO is ready to operate.
All processes that started prior to the entry into force of the Guidelines will continue to be processed in accordance with the regulations in force at the time of their submission.
