On March 24th, the Ministry of Labor and Social Welfare published in the Federal Official Gazette (DOF) amendments to certain articles of the Social Security Law (“Law”).

Consequently, in the case of insured women who are pregnant, they may request that their benefit be paid out in one installment, for which a single certificate of incapacity for 84 (eighty-four) days will be issued.

Additionally, insured women may request the transfer of up to 4 (four) weeks of pre-birth leave of absence to the period after childbirth. In order to do so, she must have written authorization from the doctor in charge of her prenatal control and surveillance, whether from the institute or externally, and consider the opinion of her employer and the nature of the work she performs.

If the authorization is issued by a private physician, it must contain the name and professional license number, the date and the medical condition of the insured worker.

These amendments to the Law became effective on March 27th, 2023.
