Amendment to the Federal Labor Law establishes fines of up to $162,855.00 Mexican pesos for noncompliance with employer obligations.
On April 4, 2024, the Decree amending Section III of Article 994 of the Federal Labor Law (the “LFT”) was published in the Federal Official Gazette, which establishes fines for non-compliance by the employer regarding certain obligations.
The fines established in this reform range from 50 to 1500 Units of Measurement and Actualization ($5,428.50 – $162,855.00 Mexican pesos).
The obligations in question are as follows:
- Affiliation of the workplace to the Institute of the National Fund for Workers’ Consumption (INFONACOT).
- Make deductions of union dues.
- Issue proof of the number of days worked and salary at the employee’s request.
- Granting workers the necessary time to vote in elections.
- Providing a safe space for workers to store their own instruments.
- Allowing workers to miss work in order to carry out a union or governmental assignment.
- Establish basic schools in case of meeting the required conditions.
- Establish academic scholarships for its employees or their children in case of meeting the required conditions.
The decree came into force on April 5, 2024.
