The Mexican Congress published in the Federal Official Gazette (“DOF”) the amendments to Articles 76 and 78 of the Federal Labor Law (“Law”), which regulate matters relating to vacation time for workers in Mexico.
Pursuant to this amendment, workers who have been working for more than one year at their place of work shall be entitled to enjoy a paid vacation period of twelve (12) days.
Additionally, said period shall be increased by two (2) working days per year worked until reaching twenty (20) days. After the sixth year, this period shall be increased by two (2) days for every five (5) years worked.
The employee will have the possibility to choose to take the twelve (12) days continuously or to distribute them as preferred.
This amendment will become effective on January 1st, 2023 and will be applicable to both individual and collective bargaining agreements in force, provided that it is more favorable to the rights of workers under such agreements.
