On November 23, 2023, the Mexican Social Security Institute (“IMSS”) and the Ministry of Labor and Social Security (“STPS”) announced the second phase of a pilot program aimed at the regularization of the companies (“Companies”) registered in the Registry of Providers of Specialized Services or Specialized Works (“REPSE”) with respect to compliance with their labor and social security obligations.

In this second phase of the pilot program, the IMSS and the STPS seek to cancel the registration in the REPSE of companies that repeatedly receive a “negative” or “no opinion” from the authorities.

The program will be carried out in the following stages:

  • The IMSS will share with the STPS the information of the Companies that do not comply with their social security obligations.
  • The IMSS will analyze the Companies’ compliance with their social security obligations and will issue an opinion on their compliance with said obligations.
  • The Companies that obtain a “negative” or “no opinion” opinion will be notified in order to regularize their compliance with the above-mentioned obligations.
  • The IMSS will reissue an opinion on the Companies’ compliance with their social security obligations.
  • The STPS will begin a procedure to cancel the registration in the REPSE of those companies that have once again received a “negative” or “no opinion”.
  • A period of 5 days will commence for the Companies to respond.
  • The IMSS will issue a third opinion on the compliance of the Companies with their social security obligations.
  • The STPS will proceed to the immediate cancellation of the registration of the Companies that have received a “negative” or “no opinion” opinion in the REPSE.
